Terms of Service

These Terms of Service ("Terms") govern your use of ThrowVerse — the game, the website at throwverse.com, and the ThrowVerse mobile applications (together, the "Service"). The Service is operated by KDEP Enterprise LLC ("KDEP Enterprise", "we", "us"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
The Service is not directed to children under 13, and you may not use it if you are under 13. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms. See our Privacy Policy for how we handle children's privacy.
2. Your account
Some features — saving progress, friends, leaderboards, challenges and Live Throw — require an account. You can create one with an email address or by signing in with Google or Apple. You are responsible for keeping access to your account secure, and for activity that happens under it. Please tell us promptly at contact@throwverse.com if you believe your account has been compromised.
You may delete your account at any time from Settings → Delete Account in the app, or at throwverse.com/delete-account. Deletion is permanent and removes your account and associated data, including scores, achievements and friend connections.
3. Acceptable use
ThrowVerse is a skill game and its competitive features only work if scores mean something. You agree not to:
- Cheat, use automation, bots, macros, modified clients, or otherwise submit scores not produced by genuinely playing the game;
- Interfere with, disrupt, overload or attempt to gain unauthorised access to the Service or its infrastructure;
- Reverse engineer, decompile or attempt to extract source code from the Service, except where that restriction is prohibited by law;
- Harass, abuse, impersonate or threaten other players, including through display names, friend requests or Live Throw;
- Use the Service for any unlawful purpose, or in breach of any applicable law or regulation;
- Attempt to interfere with, obscure, or artificially generate interactions with advertising shown in the Service.
We may remove scores, reset statistics, or suspend or terminate accounts that we reasonably believe are in breach of these rules.
4. Scores, XP, levels and ranks
Points, XP, levels, ranked tiers, achievements, challenge placements and leaderboard positions are features of the Service. They have no monetary value, are not property, cannot be bought, sold, transferred or exchanged, and cannot be redeemed for money or anything of value. Nothing in the Service is a prize competition, a wager or a game of chance for money.
We may adjust, recalculate, correct or reset scores and rankings where necessary — for example to fix a bug, remove cheated results, or settle a challenge period correctly.
5. Advertising
ThrowVerse is free and funded by advertising. The Service displays banner ads, occasional ads between games, and an optional rewarded ad that you may choose to watch to double the XP from a game you have just completed. Rewarded ads are always optional; declining one costs you nothing.
Ads are served by third-party ad networks — Google AdMob in the mobile apps and Google AdSense on the web. Those networks are independent controllers of the data they collect and operate under their own terms and policies. We do not control the specific ads served, though ad content is limited to a PG maximum rating. How consent, tracking permission and personalisation work is described in our Privacy Policy.
Rewarded XP is verified on our servers before it is granted, and each game can be doubled only once.
6. Availability and changes to the Service
We may add, change, suspend or discontinue any part of the Service — including game modes, scoring rules, balance values, leaderboards and challenge prizes — at any time. We may also update the game's mechanics as part of ordinary balancing. We do not guarantee that the Service will be available uninterrupted or error-free, and Live Throw in particular depends on a working network connection.
7. Intellectual property
The Service, including its software, game design, artwork, text, guides and the ThrowVerse name and logo, is owned by KDEP Enterprise LLC and protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial entertainment, subject to these Terms. All rights not expressly granted are reserved.
You may quote short extracts from our guides with attribution and a link. Wholesale reproduction of the Service's content is not permitted without written permission.
8. Third-party services
The Service uses third-party services including Google and Apple sign-in and the ad networks named above. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for third-party services or their content.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination — including sections 4, 7, 10, 11 and 12 — will survive.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that scores, rankings or synchronisation will always be accurate or preserved. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, KDEP Enterprise LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, progress, scores, rankings, profits or goodwill, arising out of or relating to your use of the Service. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed one hundred United States dollars (US$100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
12. Governing law
These Terms are governed by the laws of the United States and of the state in which KDEP Enterprise LLC is organised, without regard to conflict-of-law principles. Nothing in these Terms removes any mandatory consumer protection rights you have under the law of your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the "Last updated" date above. Material changes will be highlighted in the Service where practical. Continuing to use the Service after an update means you accept the revised Terms.
